Terms of Service

By accessing or using FreightOps Pro ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

FreightOps Pro is a cloud-based Transportation Management System (TMS) that provides fleet management, dispatch operations, accounting, compliance tracking, and related services for freight and logistics businesses.

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.

You are responsible for safeguarding the password and for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use.

You may not use as a username the name of another person or entity that is not lawfully available for use, or a name or trademark that is subject to rights of another person or entity without authorization.

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis (monthly or annually), depending on the plan you select.

At the end of each billing period, your subscription will automatically renew under the same conditions unless you cancel it or FreightOps Pro cancels it.

A valid payment method is required to process the payment for your subscription. You shall provide accurate and complete billing information.

FreightOps Pro may offer a free trial for a limited period. You may be required to enter billing information to sign up for the free trial. If you do enter billing information, you will not be charged until the free trial has expired. On the last day of the free trial period, unless you cancelled your subscription, you will be automatically charged the applicable subscription fee.

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Service and informs users of our data collection practices.

You retain all rights to your data. By using the Service, you grant FreightOps Pro a license to use, store, and process your data solely for the purpose of providing the Service to you.

You agree not to use the Service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the rights of others
• To harass, abuse, insult, harm, defame, slander, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To interfere with or circumvent the security features of the Service

The Service may integrate with third-party services such as QuickBooks, banking providers, ELD/telematics systems, and others. Your use of these integrations is subject to the terms and policies of those third-party providers. FreightOps Pro is not responsible for the availability, accuracy, or reliability of third-party services.

The Service and its original content, features, and functionality are and will remain the exclusive property of FreightOps Pro and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without prior written consent.

In no event shall FreightOps Pro, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
